General terms and conditions of sale

These conditions of sale are concluded on the one hand by the micro-enterprise AMAS Concept, located 17 chemin de Porterie in Sadirac (France), SIRET number 84802117600021 and, on the other hand, by any natural or legal person wishing to carry out a purchase via the website https://www.olympia-astrology.com, hereinafter referred to as “the buyer”.

Article 1. Object

These conditions of sale aim to define the contractual relations between AMAS Concept and the buyer and the conditions applicable to any purchase made through the website https://www.olympia-astrology.com. The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale, of which the buyer acknowledges having read prior to his order. Before any transaction, the buyer declares that the purchase of products on the site https://www.olympia-astrology.com has full legal capacity, allowing him to commit to these general conditions of sale.

The company AMAS Concept retains the possibility of modifying these conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.

Article 2. Products

The products offered are those which appear on the site https://www.olympia-astrology.com of the company AMAS Concept, without any stock limit, the products being downloadable software. Each product is presented on the website in the form of a description listing its main technical characteristics. The screenshots presented on the site are as accurate as possible but do not commit the Seller in any way, to the extent that they are taken on a certain version of the software, potentially prior to that which will be delivered to the buyer.

Article 3. Price

The prices appearing on the product page in the internet catalog (shop) are prices in US Dollars ($) all taxes included (TTC) taking into account zero-rate VAT. The company AMAS Concept reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated include delivery costs, the software being downloadable, these costs are zero.

Article 4. Order and payment terms

For any order, the buyer must go to the Shop page of the site, choose the product of their choice and follow the instructions on the site to make the purchase. The company AMAS Concept offers the buyer the opportunity to order and pay for their products in several stages, with 2 payment options to choose from:

– Payment by bank transfer: the buyer selects the products he wishes to order in the “cart”, modifies if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, the buyer chooses the payment method of their choice: “Payment by bank transfer”. Finally, the last step asks him to check all the information, read and accept these general conditions of sale by checking the corresponding box, then invites him to validate his order by clicking on the “Order” button. This last click forms the definitive conclusion of the contract. Upon validation, the buyer receives an order form confirming the registration of their order. In order to finalize their payment and trigger the processing of their order, the buyer must contact their bank in order to make the transfer corresponding to the amount of their order to the AMAS Concept bank account, the details of which are communicated to the buyer. Upon receipt of the transfer, the order will be processed and the buyer will be informed by email. AMAS Concept will ship the products no later than 2 working days after receipt of the transfer corresponding to the order.

– Secure payment by Stripe or bank card (via the STRIPE system): the buyer selects the products he wishes to order in the “cart”, modifies if necessary (quantities, references, etc.), checks the delivery address or provides news. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method of their choice: “Stripe”. The next step asks him to check all the information, read and accept these general conditions of sale by checking the corresponding box, then invites him to validate his order by clicking on the “Order” button. Finally, the buyer is redirected to the secure STRIPE interface in order to securely enter their Stripe account or personal credit card references. If payment is accepted, the order is recorded and the contract is definitively formed. Payment by Stripe account or credit card is irrevocable. In the event of fraudulent use of the card, the buyer may demand the cancellation of the card payment, the sums paid will then be recredited or returned. The liability of the bank card holder is not incurred if the disputed payment has been proven to have been made fraudulently, remotely, without physical use of their card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the card holder must contest, in writing, the debit with their bank, within 70 days following the transaction, or even 120 days. if the contract binding him to it so provides. The amounts withdrawn are reimbursed by the bank within a maximum period of one month after receipt of the written dispute filed by the holder. No costs for returning the sums may be charged to the holder.

Confirmation of an order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and waiver of the right to rely on one’s own conditions of purchase. All data provided and the recorded confirmation will constitute proof of the transaction. If the buyer has an email address and has provided it on their order form, AMAS Concept will send them confirmation of the registration of their order by email. Article 5. Reservation of ownership

The AMAS Concept company retains full ownership of the products sold until full payment of the price, in principal, fees and taxes included.

Article 6. Withdrawal

As long as the order has not been shipped, you have the possibility to cancel it by contacting AMAS Concept by email olympia.astrologie@gmail.com or via the “Contact” page of the site https://www.olympia-astrology .com. Even if payment is made through the Stripe interface, the funds involved will be refunded, less the payment fees retained by the corresponding online purchasing interface.

Once the order has been delivered, that is to say once the password allowing access to the software has been delivered by email to the customer, any refund request will be refused. We remind you that the future user of software delivered on the site can request a free trial version, allowing them to validate proper functioning on their personal computer.

Article 7. Delivery

Deliveries of software sold on the site https://www.olympia-astrology.com are completely dematerialized. This involves delivery by sending emails, the first containing the software download link, then the second the security code allowing the software to be unlocked. An internet connection is therefore essential for delivery of the software ordered. The size of the file to download does not exceed 300 MB, the download process remains very fast.

Article 8. Guarantee

All software provided by AMAS Concept is guaranteed to work for recent operating systems: Windows 7, Windows 8, Windows 10, Windows 11, MacOS Sierra, MacOS High Sierra, MacOS Mojave, MacOS Catalina, MacOS Big Sur, MacOS Monterey, MacOS Ventura, MacOS Sonoma.

Article 9. Liability

The company AMAS Concept, in the distance selling process, is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, interruption of service, or other unintentional problems.

Article 10. Intellectual property

All elements of the site https://www.olympia-astrology.com are and remain the intellectual and exclusive property of the company AMAS Concept. No one is authorized to reproduce, exploit, or use for any reason whatsoever, even partially, elements of the site, whether in the form of a photo, logo, visual or text.

Article 11. Personal data

The company AMAS Concept undertakes to preserve the confidentiality of the information provided by the buyer, which he may be required to transmit for the use of certain services. Any information concerning him is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the Internet user has the right to access, modify and delete information concerning him. Article 12. Dispute resolution

These distance selling conditions are subject to French law. For all disputes or disputes, the competent court will be that of Bordeaux.

Article 13. New-station installation

The purchase of Olympia Astrology software is linked to installation on a single computer. If the user wishes to purchase new Olympia software, for an equivalent operating system (Windows, MacOS, Linux) on a new computer, a product on the Shop page allows this : Olympia Astrology – New Station. This installation is thus invoiced and follows the same rules as the first purchase of the software, in particular concerning payment methods and delivery times. During this purchase, AMAS Concept requests proof of ownership of the new computer from the client in order to protect against unauthorized software copying to a third party. If no proof of ownership is provided, AMAS Concept reserves the right to cancel the order and refund the client, for the product price minus the commission fees from the initial purchase.

Article 14. Module of use of artificial intelligence (EgerIA)

a) Preamble

These General Terms and Conditions of Sale (GTCS) govern the use and sale of the EgerIA module, which uses OpenAI’s ChatGPT technology to provide information and services to its users. By purchasing and using an EgerIA license, the customer fully accepts these GTCS. It is important to note that the EgerIA module operates within the Olympia Astrology software: the EgerIA module will only be operational on a computer, and only one, that already has the Olympia software installed. The technical constraints regarding the use of EgerIA are also reminded: having an internet connection during its use, without a firewall blocking communication with OpenAI’s servers; if the user has a computer with the Windows operating system, this version of Windows must be 64-bit (EgerIA is not operational on a 32-bit Windows system). In any case, starting from version 5.3.0 of the Olympia Astrology software, the EgerIA module is in trial version, allowing the user to verify its proper functioning.

b) Definitions

• Customer: Any individual or legal entity that has purchased a license to use EgerIA.
• EgerIA Module: The product sold, which includes access to ChatGPT developed by OpenAI to provide information to the Customer.
• ChatGPT: The language model developed by OpenAI, used within the Software to interact with users.
• OpenAI: The entity that develops and maintains the ChatGPT model.

c) Purpose

These GTCS aim to define the terms and conditions of use and sale of EgerIA, which includes access to information generated by ChatGPT. The Customer acknowledges that the information provided by EgerIA is based on an AI model, and that OpenAI assumes no responsibility for the information provided.

d) Intellectual Property

EgerIA and all associated intellectual property rights are and remain the exclusive property of AMAS Concept and the designer of Olympia Astrology. The Customer is granted a personal, non-exclusive, non-transferable, time-limited, and limited-use license (number of queries) for the use of EgerIA.

e) Use of ChatGPT and OpenAI

The Customer acknowledges that:

• EgerIA relies on ChatGPT, a model developed by OpenAI, and that the use of this service is subject to OpenAI’s Terms of Use, available at the following links: https://openai.com/policies/terms-of-use/ and https://openai.com/policies/row-terms-of-use/
• OpenAI does not guarantee the accuracy, reliability, or completeness of the responses provided by ChatGPT.
• The information generated by ChatGPT is automated and may contain errors. The Customer is responsible for verifying this information before using it.
• OpenAI may modify or discontinue access to its service at any time. AMAS Concept and the designer of Olympia Astrology cannot be held responsible for any interruption, limitation, or modification of ChatGPT by OpenAI.

f) Liability

EgerIA is provided « as is ». AMAS Concept, the designer of Olympia Astrology, and OpenAI disclaim any liability for decisions made by the Customer based on the information provided by EgerIA. AMAS Concept and the designer of Olympia Astrology shall not be held liable for any direct or indirect damages resulting from the use of EgerIA. The Customer is responsible for the use of EgerIA and the information obtained via ChatGPT, and acknowledges that this information may not be suitable for specific situations or professional purposes.

g) Payment and Purchase Terms

The price of the EgerIA license is indicated on the Olympia website’s Store page: Shop. Payment must be made at the time of purchase and may be subject to applicable taxes. Once the license is purchased, the Customer will receive access to EgerIA after an activation request within the Olympia Astrology software. The Customer is informed that, having the option to benefit from a trial period of the EgerIA module in Olympia, no refund requests will be accepted.

h) Duration and Termination

The license is granted for a specified period determined at the time of purchase. At the end of this period, the Customer must renew their license to continue using EgerIA. Additionally, the license includes a usage restriction, either daily or monthly. The Olympia Astrology software clearly indicates the expiration date and the daily or monthly usage limit at the time of use. The Customer is not entitled to cancel a subscription or request a pro-rata refund based on usage. The subscription purchased with the license is fully payable upon subscription.

i) Personal Data and Confidentiality

The use of EgerIA does not involve any data collection by AMAS Concept and the designer of Olympia Astrology, in accordance with the privacy policy described here: Privacy Policy. OpenAI may collect data in accordance with its own privacy policies: https://openai.com/policies/privacy-policy/

j) Modifications to the GTCS

AMAS Concept reserves the right to modify these GTCS at any time. The Customer will be informed of any changes, and their continued use of EgerIA will constitute acceptance of the modified GTCS.

k) Governing Law and Jurisdiction

These GTCS are governed by French law. For any disputes or litigation, the competent court will be that of Bordeaux.

l) Change of computer

As described in the general terms and conditions of sale of the Olympia Astrology software, the use of the software is limited to a single computer following its purchase. To install and use Olympia on a new computer, it is necessary to acquire an ‘Olympia new station’ product for any new installation. If the client has purchased the EgerIA module on the first computer, when subsequently purchasing the ‘Olympia new device’ product, their license will be transferred to the new computer. The activation request can be made through the designated interface in the software, and the activation code will be sent to the client. However, if the client already has multiple software copies on several computers, in the case of acquiring an EgerIA license, the license will only be activated on one computer.
